Terms of Service for Matchups.AI

Welcome to Matchups.AI (“Matchups AI,” “we,” “us,” or “our”). Our platform delivers smarter, faster sports prediction insights powered by three independent AI minds. These Terms of Service (“Terms”) govern your access to and use of our website, services, and applications (collectively, the “Service”).

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, do not access or use the Service.

  1. Acceptance of Terms By creating an account, logging in (including via Facebook, Google, or X), or otherwise using our Service, you represent that you have read, understood, and agree to be bound by these Terms.
  2. Eligibility & Age Verification You must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater, to create an account and use our Service. By using the Service, you represent and warrant that you meet this age requirement. We may perform age verification checks and reserve the right to suspend or terminate accounts if we believe this requirement is not met. Proof of age may be required.
  3. Description of Service Matchups AI provides AI-powered sports predictions and analytics for informational and entertainment purposes. Key features include: * AI-Powered Predictions: Insights for sports such as NBA and MLB (with NFL, CFB, CBB planned). * Triple AI Collaboration: Predictions derived from the analysis and consensus of three independent AI models (referred to as “Jack,” “Jill,” and “Bob”). * Transparent Reasoning: Users can access the “View Analysis” feature to understand the AI’s reasoning, including roster information, individual AI thoughts, and synthesized decisions. * Daily Predictions & Parlay Picks: Including “Parlay of the Day” and “Safe Parlay” selections based on high-probability, strong-consensus games. * Analytics Hub: Access to AI historical accuracy, personal prediction success tracking, and consensus pick data (GLOBAL averages available with premium subscriptions). * Real-Time Data & Simulation: Our AI processes real-time data (news, injuries, odds, trends) and runs complex simulations. * Tokens: Predictions are accessed using “Tokens.” One (1) Token is typically used for one (1) game prediction.
  4. Account Registration and Use * Account Creation: To access certain features, including predictions, you must register for an account. You may register directly or through supported social media platforms (Facebook, Google, X). * Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. * Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. * Free Trial: We may offer a 3-Day Free Trial for all plans, subject to specific terms provided at the time of the offer. * Sign-Up Bonus: New users may receive complimentary Tokens (e.g., 20 tokens) upon signing up.
  5. Tokens and Subscriptions * Tokens: The Service operates on a Token-based system. Each prediction request consumes a specified number of Tokens from your account. Your Token balance is displayed on the Service. * Purchasing Tokens: Additional Tokens can be purchased through the Service. All purchases are final and non-refundable except as required by law or at our sole discretion. * Subscriptions: We may offer subscription plans that provide access to premium features, such as GLOBAL averages in the Analytics Hub. Subscription terms, including fees and renewal policies, will be presented at the time of purchase. * Usage Limits: There may be a limit on the number of predictions you can have processing simultaneously (e.g., a typical limit of 3).
  6. Service Usage and Limitations * Informational and Entertainment Purposes Only: The predictions and information provided by the Service are generated by AI analysis and are intended strictly for informational and entertainment purposes. * Not Gambling Advice: The Service does not constitute financial or gambling advice. Predictions are based on data models and simulations, and outcomes are not guaranteed. * No Gambling Facilitation: Matchups AI is not a gambling operator and does not accept, facilitate, or manage wagers of any kind. We are not affiliated with any gambling services or sites. * User Responsibility: Your use of any information or predictions from the Service is strictly at your own risk. You are solely responsible for any decisions you make based on this information. * Prediction Process: AI analysis for a prediction can take several minutes (typically 1-3 minutes, but potentially longer). Statuses like “Thinking…,” “Complete,” or “Failed” will indicate the progress. If a prediction fails, Tokens may be refunded as per our operational policies.
  7. Intellectual Property Rights All rights, title, and interest in and to the Service (excluding content provided by users) are and will remain the exclusive property of Matchups AI and its licensors. This includes all software, text, graphics, logos, AI models, algorithms, prediction data, and user interface elements. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
  8. User Conduct You agree not to use the Service: * In any way that violates any applicable national or international law or regulation. * For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way. * To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation. * To impersonate or attempt to impersonate Matchups AI, a Matchups AI employee, another user, or any other person or entity. * To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm Matchups AI or users of the Service or expose them to liability. * To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  9. Third-Party Services Our Service allows login through social media platforms (e.g., Google, Facebook, X) and uses Google Analytics 4 (GA4). By using these features, you agree to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.
  10. Privacy Your privacy is important to us. Our Privacy Policy, available here, explains how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of personal data as outlined therein.
  11. Disclaimer of Warranties THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WHILE WE STRIVE FOR ACCURACY, PREDICTIONS ARE BASED ON DATA MODELS AND SIMULATIONS, AND OUTCOMES ARE NOT GUARANTEED. ALL INFORMATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. MATCHUPS AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  12. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MATCHUPS AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. WE ARE NOT LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM THE USE OF INFORMATION OR PREDICTIONS FOUND ON THIS SITE. PLEASE GAMBLE RESPONSIBLY AND ADHERE TO THE LAWS IN YOUR JURISDICTION IF YOU CHOOSE TO ENGAGE IN GAMBLING ACTIVITIES ELSEWHERE.
  13. Indemnification You agree to defend, indemnify, and hold harmless Matchups AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
  14. Termination We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may do so by contacting us or through your account settings, if available. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
  15. Governing Law These Terms shall be governed and construed in accordance with the laws of [Insert Your State, e.g., Delaware or the state where your business is primarily based], United States, without regard to its conflict of law provisions.
  16. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
